Jaypee Issued A Final Notice By YEIDA To Pay Dues Of Rs.900 Crore

yamunaxpresswayA final notice has been issued to Jaypee Infratech by the Yamuna Expressway Industrial Development Authority (YEIDA) making clear that it has to pay a sum of Rs.900 crores, otherwise the allotment of 1000 hectares of land will be cancelled.

The developers have been issued a show-cause through which they are asked to justify and explain that why their allotment should not be cancelled. Stringent and harsh action will be taken which can also include cancelling the lease, if Jaypee Infratech is not able to pay its dues by 15th April.

Jaypee Infratech has been at default for paying the installments for the allotted land even after several reminders by YEIDA. The land has been allotted to Jaypee Infratech for the last five years in three different pockets of YEIDA area for the construction of residential units. Till date, the construction has not even been started by the developers. The allottees are also facing hardships, the reason being the default of developers.

Apart from the notice issue by YEIDA to Jaypee Infratech to pay dues of Rs.900 crore, it also has to pay an additional amount Rs.1200 crore. This additional amount is in account of the compensation to be paid to the farmers for acquiring land in the area. This matter, however, is under judicial consideration and will be executed after an adjudicator steps in.

According to the sources, Jaypee Infratech refused to have received any notice from YEIDA.
Apart from Jaypee Infratech, YEIDA has seven more builders on its cards to be issued a show-cause notice. Before issuing, YEIDA is already in the process of cancelling seven allotments of these builders.

Fight For RERA Accuses States For Dilution Of Real Estate Regulatory Act

Fight For RERA Rajya Sabha’s Committee on Subordinate Legislation (COSL) has made an appeal in writing, to PM Modi and Union Minister, M Venkaiah Naidu, asking them to review the rules of RERA (Real Estate Regulatory Act). They have complained about the weakening of RERA rules by the state government in the favour of the realty builders.

Fight-For-RERA, a homebuyers’ association, had requested for the involvement of COSL to get certified that the rules made and executed at the final stage by the states, are within the loop of RERA. Notification of the Act was done on 1st May, 2016. After that, all the states were given a time period of six months to notify their final rules. But till date, Uttar Pradesh, Gujarat, Orissa and Madhya Pradesh are the only states that have notified their final rules. Karnataka, Maharashtra, Rajasthan, Tamil Nadu and West Bengal are in process of finalizing their rules as they framed a draft.

As per the allegations by the FIGHT For RERA association, all the rules made by the central government have been diluted and weakened by the states in support of the developers.

That is why the intervention of COSL is necessary to end the impartiality by the states. Along with the Prime Minister and Union Minister, Fight for RERA has also made an appeal to the Chief Ministers of Gujarat, Uttar Pradesh and Haryana to bring the dilution of RERA rules into public notice.

The matter in concern was brought into the notice of COSL, as it can have some harsh and critical consequences in the future. Understanding the seriousness of the matter, the committee has also come to action to bring credibility.

The homebuyers have become expectant now regarding the notification of fresh RERA rules.

Possession Of 6000 Flats, Plots In Greater Noida By YEIDA Confirmed

YEIDAAfter seven years of getting allotment by the Yamuna Expressway Industrial Authority (YEIDA), there is some good news for the allottees. The authority has taken the decision of giving possession of 6000 residential flats and plots in Greater Noida in the next couple of months. The first group which consists of 3055 allottees, have already got the letters of possession by the Authority, in the months of January and February this year.

As per the sources, the location of these 6000 flats and plots will be in sectors 22A, 22D, 18 and 20. These plots were allotted long back in between 2009-2013. Possessions are being handed over to those allottees who have their plot sizes measuring 300 meters to 500 meters.

The allotment will be done as follows, as per the sources –
• In sector 20, 666 plots will be given in pockets O and Q.
• In sector 18, 435 plots will be given in pockets 2A and 2C.
• In sector 22A, 4028 plots will be handed over.
• In sector 22D, 900 plots will be handed over.

Possession to 55 allottees, who have plots of size 400 meters, has already been given in sector 20 (Pockets A and B).

Enhanced compensation to farmers (whose land was acquired) has also been approved by YEIDA and will be distributed within another one month. Various farmers from around 77 villages are raising their voices for getting a hiked compensation of 64.7% for their land which was acquired by YEIDA.

There is a little hindrance faced by the allottees in securing their possessions because of the commotion caused by the farmers regarding the compensation. But YEIDA is trying to solve the issue by giving as much compensation as possible to as many farmers as possible. This is being done so that plot owners can get the possession of the land allotted to them.

94 Cities Granted The Credit Ratings In Smart City Mission

Smart CityThe task of credit ratings of cities is increasing at a fast pace and the result is that out of the 500 cities involved in the smart city mission, 94 have got the credit ratings. Atal Mission for Rejuvenation and Urban Transformation (AMRUT) also covers these cities.

During the scrutiny of the task of credit ratings in India, a government release came out reporting that 55 out of these 94 cities have been granted the ‘Investment Grade’ ratings.

The 94 cities which have been given the credit ratings in India are scattered across 14 cities.

Credit rating of cities is being stimulated by the Ministry of Urban Development as a part of the Transformation Reforms. Under these Transformation Reforms, all the cities that have 65% of their population as urban, they were eligible for Credit Ratings this year.

The ratings have a range from AAA to D, where BBB is equivalent to the ‘Investment Grade’ rating. All the cities which are given a rating that is below BBB are required to take adequate steps to improve their conditions. In turn, their ratings will improve to get positive response for issuing Municipal Bonds.

To get assigned, Credits Ratings have various bases to review, which are –
• Revenue streams
• Double entry accounting practice
• Assets and liabilities of Urban Local Bodies
• Available resources for making capital investments
• Other governance practices

MoS Rathore-Parsvnath Developers Flat Dispute Must Reach Settlement: SC

Parsvnath DevelopersThe Supreme Court has been recently told that there are chances of an understanding being achieved between Parsvanath Developers and Union Minister Rajyavardhan Singh Rathore. The settlement is in regards with the possession of a flat in Gurgaon which was being discussed for a while.

Both the counsels representing the respective parties have told the Justices that an agreement between them are to take place soon. The next date of hearing is as 10th April and the counsels are ordered to file the details of agreement on the same date.

The court was informed on 20th February that the settlement between Parsvanath Developers and MoS Rathore had almost taken place. The draft regarding the negotiations had also been exchanged between the two parties.

The court had appointed two lawyers to take into consideration the accusations made by MoS Rathore. According to the lawyers, the apartment given to him was unsuitable for living.

Then on 12th of January, there was information of an agreement and settlement being reached.

The Supreme Court had also suggested MoS Rathore to solve the matter and come to a settlement with the developers, in a harmonious manner. It had even asked the developers to work on the shortcomings and flaws in the flat which MoS Rathore was facing.

As per the sources, a flat had been booked by MoS Rathore in 2006 Parsvnath’s Exotica in Gurgaon. The delivery was expected in 2008-09 after he paid Rs.70 lakhs for it.

The developers had earlier been ordered to compensate MoS Rathore by refunding him the principal amount with the interest by the National Consumer Disputes Redressal Commission (NCDRC).

Supertech Towers Will Be Destroyed If Not Sanctioned Appropriately

supertechThe Supreme Court has announced that if the Supertech’s two 40-storey Emerald Towers will be demolished if they are built without a sanction.

Allahabad High Court’s verdict of April 2014 had instructed the demolition of the tow twin towers of Supertech in Noida. It had also ordered Supertech to return the money to the homebuyers along with the interest of 3 months. A bench was formed comprising high officials and pleas were heard by them against this verdict.

The flats combined in the two towers come to a total of 857 and 600 out of them are sold off.

The bench during the hearing made clear that any homebuyer can come out of the project at their will if they want to. And similarly if they want to continue with the project and stay, they can.

A counsel had appeared from Noida Authority’s side which informed the bench that the sanctioned plan for the towers was prepared, keeping in mind the guidelines.

Buyers also had complaints that even after the high court’s orders, the amount had not been refunded to them.

In the developer’s defense, the counsel appearing for them said that the money had been refunded to the homebuyers. It also said that the applications for refunding the money would be executed within four weeks and the principal amount would be given back to them.

The builder had paid Rs.5 crore as per the court orders. This has settled the matter till August 9th, the final hearing date.

National buildings construction corporation (NBCC) was asked to inspect and analyze the Supertech’s emerald towers to check if the twin towers were defying the sanctioned plan. NBCC was supposed to submit a report on the same.

Land Allotment Rates Revised By DMIC Township In Greater Noida

Pertaining to the decrease, the revised rates of land allotment will go down to Rs.5100 instead of the current land allotment rate of Rs.7000 per square meter in this slab. The decision to lure the first investor by giving him an incentive in the form of a concession of 20%, in the land allotment rate for industrial plots, has also been approved by the board.

But this availing of rebate will be applicable only if the construction is started quickly.
