90% Withdrawal Allowed From EPF Accounts For Home Loan

The Central Government has decided to amend the Employee Provident Fund (EPF) scheme which will allow more than 4 crores members of EPFO to make the by withdrawing 90%down payments for buying houses of their funds.

Moreover, this amendment also gives the provision of using their EPF to even pay the Equated Monthly Installments (EMIs) of the home loans.

Under this scheme, all the subscribers will have to make a group housing cooperative society of at least 10 members in each society if they want to avail the facility. This group housing society would then get collaborated with builders, banks or sellers of homes to make the EPFO members buy homes.

Bandaru Dattatrey, Union Labour Minister, told Rajya Sabha that this provision proposal which has to be inserted in the EPF scheme has not been informed yet. Because of this, targets are not fixed under this benefit for giving advances. According to the annual report, the total number of members of EPF as on 31st march, 2016 were 17.14 crore. During the same year, 3.76 crore members made contributions.

All the conditions prescribed under the scheme will have to be fulfilled by the PF members if they want to avail the withdraw facility from their PF accounts.

Long Awaited Amended Enemy Property Bill Passed By Lok Sabha

LOK SHABHAA 49 year law has been amended finally on Tuesday, denying the inheritance rights to the legal heirs of the individuals leaving country for China or Pakistan. Known as Enemy Property Amendment and Validation) Bill, 2016, this bill clarifies that the heirs will no longer have the entitlement for property inheritance in India, if their ancestors shifted the enemy countries – Pakistan and China. The Lok Sabha has passed the bill and a selected committee appointed by Upper house has recommended some amendments. This is so far the fifth ordinance on this issue. The bill was passed by the Rajya Sabha with voice vote at the time when the opposition benches were almost vacant on March 10.

After Indo-Pak war in 1965, previous Enemy Act was enacted in 1968 but it required a much awaited clarification which has been brought under the current bill clearly denying the right of inheritance. Few MPs however expressed their concerns regarding this implementation but it has been assured that there shall be no human right violation and the law solely applies to the heirs of enemy properties. “Enemy Property” covers any property held, belonging to or managed on the behalf of an enemy, an enemy firm or an enemy subject.

263 properties in Goa have been already identified even before the passing of the bill, which belong to Pakistani citizens. These are estimated at a value of around 100 crores and located in various areas as Tiswadi, Bicholim, Salcete and Bardez. The ministry of Home affairs estimated the enemy properties to be worth of more than Rs. 1 lakh crore.

This law came into consideration after a claim in the property in Uttarakhand and Uttar Pradesh by the heirs of Raja Mohammad Amir Mohammad Khan. A petition regarding this is filed in the Supreme Court.

• Funds received by normal banking networks in India from abroad via inward payment.
• Funds in the non-resident account maintained as per the latest laws made by RBI and the Foreign Exchange Management Act, 1999.

 

Builders Must Stand To Their Promises To Gain Homebuyers’ Trust

Both RERA and the Benami Transactions Act are working in the favour of real estate sector to gain back the trust and confidence of homebuyers. But as announced by M.Venkaiah Naidu at the CREDAI (Confederation of Real Estate Developers’ Association of India) Conclave, developers must also understand their responsibility and should keep their promises by delivering the projects on time.

The developers have demanded that the ongoing projects should not be included in RERA and it should only be applicable to the new launches.

CREDAI is the highest body of builders and developers in India, with over 1100 members.

The developers are advised by the government to complete what they have promised on paper. They do not need to fulfill anything more than their advertisement, and that they simply have to stick to everything mentioned in their advertisements.

Aim of RERA is to bring back the character of the real estate sector and will prove to be a significant step. It will help in removing the unreliable and undependable developers from the market at one go. Apart from this, government has already granted infrastructure status to affordable housing as an initiative. All the chief ministers have also been asked in written to waive off the stamp duties for affordable housing.

Developers, on their end, should also opt for new business models and a change in perspective, to give a make-over to the real estate sector. Digital transactions should be followed to get a transparency leading to rectification in the realty.

Union minister, M. Venkaiah Naidu also showed concern on the high land prices saying they should be brought down to make it affordable for the people. The developers were assured that they will receive approvals faster than before on real estate projects in India as a presentation on this would be made in front of the Prime Minister.

South City1 Residents Gurgaon To Begin Road Construction On Their Own

The residents of South City 1, Gurgaon, have decided to take up the responsibility of laying the road themselves. The reason for taking up this task, which should actually have been taken up by the civic body and developers, is the pure ignorance regarding the pleas by the residents for road construction in South City, Gurugram

The residents of South City 1 of blocks A,I,J and N have collected money among themselves and have hired a contractor. The work for the road will start by 15th March in full swing.
Unitech, their developer, has been consulted many times by the residents for more than two years in regards with construction of the road in South City, Gurgaon. But the developer showed no interest saying that the dues have to be cleared before any developmental work.
The areas which are right now maintained under the developers will be taken over by the

Municipal Corporation of Gurgaon (MCG). The initial phase of this takeover has already been done in February 2016 after which DLF phases 1-3, Palam Vihar, Sushant Lok-1 have come under the power of MCG. The completion of this take over has not been done yet because of the pending legal changes to the Act.

The connecting roads within the township are also in a lousy condition since long, making it troublesome for the residents to even commute within the township.

MCG (Municipal Corporation of Gurugram) had earlier claimed to take up the task of development in the residential societies saying that they would do it even if the takeover didn’t take place in one go.

But after the estimates of road repair were made and drafted, the commissioner later came out saying that it would not be possible to take up this development work unless they completed the legal process of taking over.

EPFO To Launch A Housing Scheme For Its Members In March

EPFOEmployees Provident Fund Organization (EPFO), retirement fund body, is all set to launch a housing scheme for its more than 4 crore members next month. This scheme will allow the members to make down payments and EMIs from their Employee Provident Funds (EPF) accounts, when buying homes.

This housing by EPFO scheme is expected to launch after the voting in the five poll bound states is done with, that is, after 8th march. With the help of this scheme, EPFO will encourage the subscribers to buy homes for themselves till the time they are in their service period.

All the subscribers and their employers would have to form a group housing society. This group housing society would then get collaborated with builders, banks or sellers of homes to make the EPFO members buy homes. The condition to avail the facility is that there should be at least 20 members in the group housing society.

The subscribers would be even allowed to club the benefits of various other schemes like PMAY under this housing scheme initiative of EPFO so that the vision of Housing for all by 2022 can be achieved.

The formal sector workers will also get helped in showing their credit worthiness through this housing scheme. This will benefit them because EPFO would be providing a certificate showing the subscribers’ paying capacity.
