14 Builders Face Rejections On Completion Certificates By Noida Authority

 Noida AuthorityOn Saturday, the applications for completion certificates of 14 developers were rejected by the Noida Authority. Out of all the projects, four are commercial projects while 12 are group housing projects.

As per the officials, all these developers whose applications have been rejected have not been able to fulfill the specified conditions for completion. Moreover, they had also apparently submitted their applications in a rush just to be away from the scope of RERA (Real Estate Regulatory Authority).

According to Act, all the under-construction and ongoing projects which don’t have completion certificates have to be registered with concerned regulatory authorities by the developers till the end of July.

A completion certificate is issued to validate that the project has been constructed on the lines of the sanctioned plan, specifications and layout which have been laid down under the laws. The certificate issued by the authority becomes an evidence of that housing project being complete and ready-to-move-in. Apart from this, this certificate also shows that there have been no violations of any rules and laws during the development of that building.

The officials said that the rejected 14 projects have not followed the rules and norms set to receive the completion certificate and are defective in some or the other way. The officials found this out after an inspection was conducted of 100 applications. After the rejections, the developers have been asked to look into the defects and work on them. As of now, these projects will come under ‘ongoing’ category and will have to be registered with RERA by the developers.

If the rejections are done on the basis of major blunders on the builders’ part, then they are justified. However, if the building is complete and there is only a small defect, then a period of 15 days should be given by the authority to make the necessary changes and reapply for completion certificate, as suggested by Amit Modi of CREDAI-NCR.

CREDAI To Certify Proper Execution Of RERA In Delhi NCR

RERAThe NCR branch of builders’ body Confederation of Real Estate Developers Associations of India (CREDAI) will certify that RERA (Real Estate Regulatory Act) is executed in a proper manner and the redressal forum for consumer grievances is functioning in an effective manner.

The new President of CREDAI, Pankaj Bajaj, has said that the new team formed will efficiently work towards achieving the goals of government like ‘100 Smart Cities’, ‘Housing for all by 2022’ etc. and will also integrity and accountability.

CREDAI-NCR will also pay attention to cleanliness, welfare and well-being of labours, and skill development as enduring responsibilities. The team will also work closely with CREDAI National to bring a platform for providing skill development programs.

CREDAI-NCR conducted a general meeting on 27th July, 2017, where a new leadership team was elected and formed for the years 2017-1019.

The Vice Presidents of CREDAI-NCR who have been appointed are Manish Agarwal of Satya Group, RC Gupta of RPS Group, Ajay Singh of Avalon Group, Rajesh Group of RG Group and Manu Garg of Landcraft Developers.

Hero Honda Chowk In Gurgaon Witnesses Inauguration Of An Eight-Lane Flyover

Hero Honda Chowk in GurgaonThe Chief Minister of Haryana, Manohar Lal Khattar, has inaugurated the eight lane flyover (1.4km long) developed at Hero Honda Chowk in Gurgaon. In his speech during the inauguration, the Chief Minister said that the development of this flyover would give a relief to the traffic on National Highwway-48.

The flyover will be extremely beneficial for the people commuting towards sector 10, Jhajjar, Kadipur, Sultanpur and Basai because now they instead of crossing the area of Kherki Daula, Toll Plaza, they can take a straight route from Hero Honda Chowk. The flyover will also be beneficial to people commuting to areas outside the city like Ajmer, Jaipur etc.

The development of flyover has been done as a part of three-layer crossing project at Hero Honda Chowk, whose worth is around Rs.198 crore. The project also includes underpass which is under construction and is likely to get completed by December 2017.

The Chief Minister said that the development of Gurgaon was their top priority. Even the projects which had come to a halt in the past are also being executed again in the fastest way possible.

Quality Checks To Be Kept By DM On Construction Material Used In NoidaThe district administration has taken the decision of keeping a check on the quality of materials that are being used for the construction of real estate projects.

The District Magistrate of Gautam Budh Nagar has announced that he will plan the steps to ensure that there is quality check being kept on the materials used for construction of projects by the builders. This decision has been made after various complaints by the residents about plaster coming off balconies, ceilings and even from the exteriors of buildings. The DM said that he will also discuss the problem with the authorities of Greater Noida and Noida to come up with suitable solutions.

The Noida Extension Flat Owners Main Association (NEFOMA) has demanded, while writing to the DM, that quality checks should be made compulsory by authorities of Greater Noida and Noida on the materials used for residential projects.

When Noida received heavy rains in the previous week, various residents informed about the plasters falling off from the ceilings. They have registered their complaints with both the authorities and they are adamant to take the issue to the Chief Minister as well, if needed.

 

Tenders To Be Submitted By DDA For Smart Cities In Rohini, Dwarka And Narela

DDAThe Delhi Development Authority (DDA) is all set to submit the tenders of the development of three consolidated sub-cities in in the coming month. Moreover, the construction work for development of Yamuna river front will commence from 2nd October.

This timeline was set for DDA by The Housing and Urban Affairs (HUA) on Friday. The decision taken also stated that these sub-cities will be developed in a way that they will have all the characteristics of smart cities like rain water harvesting, 100% treatment of waste, 100% water and electricity supply etc. As per the sources, these sub-cities are going to be developed in a better way than done by the private developers in Delhi NCR.

The bidding will be invited and entertained by DDA in August. The proposal by the authority is to construct consolidated cities on unoccupied and available land in Rohini (259 hectares), Dwarka (200 hectares) and Narela (218 hectares). Once the bidding starts and the developers participate, they will be chosen by October.

Builders Challenge RERA In Court By Saying Its Provisions Are Illegal

RERA RulesSome of the builders have reached out to two high courts to question a few provisions provided in the Real Estate Regulation Act (RERA). These challenged provisions include the one for having all the “ongoing” projects under RERA and laying penalties if such projects are not registered. The builders are pleading that these provisions be removed as the ongoing projects were initiated when the law was not even executed and therefore, it’s illegal.

Previously, the builders had demanded that the incomplete projects should be excluded but that request was suspended by the Central Government as it said that the law was supposed to help the homebuyers who are stuck with incomplete flats for years, even when they had made full payments. As per the law, new and incomplete projects have to be registered with the regulator by 1st August; otherwise the builders will have to pay penalties.

The builders are showing reluctance to this provision as they are facing cash-crunch. Apart from this, the law will also bring clarity, honesty and transparency in the system and the builders will have to give deadlines for delivery of the flats.

The sources of the Housing and Urban Affairs Ministry have said that RERA covers all kinds of projects which did not have a completion certificate by 1st May, 2017 and thus, does not have any retrospective effect.

Builders are challenging the Central Government’s right to implement the law related land, which actually is the concern of the state. Therefore, giving the project details to the regulator will mean violation of right to privacy.

A government official has said that the law has been implemented according to the proper provisions of Concurrent List and it also had the approval of the Law Ministry.

RERA has not been executed for matters of ‘local authority’ or ‘land’. It has been executed to control the contractual and legal responsibilities signed between the developers and homebuyers. The main aim of RERA is to have no disputes in the real estate sector.

Process Of Next Master Plan Started By The Delhi Development Body

Delhi-Master-PlanThe Delhi Development Authority (DDA) has initiated with the process of formulating the Master Plan till the year 2041 for the development of Delhi. For the plan, a Memorandum of Understanding has been signed between the land-owning agency and National Institute of Urban Affairs. (NIUA)

In the authority meeting, a proposal was approved in the same context.

NIUA has been given a time period of 48-months to develop the framework around which the growth and planning of Delhi will be done till 2041. Before executing the framework, a quantitative analysis will be done by NIUA which will involve factors like population, rate of migration, technology etc.

The MPD-2041 will have to be notified before the existing MPD-2021 expires. After the quantitative analysis, the information and data which will be collected will be presented on a GIS platform to get a clear understanding of the interdependence of developmental matters in the city. A qualitative analysis will also accompany the quantitative one via stakeholder discussions with academia, experts, government agencies and community groups.

The MPD will also give a framework and suggest changes in the various sectors like, infrastructure, environment, housing, solid waste management and transportation. Once the plan gets the approval, it will be reviewed and analysed after every 5 years.

North Delhi Corporation Plans To Reconstruct DDA Flats At Prime Locations

DDAFor all the people who were planning to buy high-end housing units in sought-after locations like Azadpur and Model Town, there is good news for them. The North Corporation has asked the developers to replace the current MCD staff quarters that are apparently in a worn-out condition, with multi-storey buildings.

The concerned civic body has started inviting the bids from different developers by issuing tenders. The deadline for the completion of both the projects is 36 months.

Although the final length of the towers has not been finalized yet, the estimations are that the towers will have 28-30 storeys. The new buildings will also be eligible to have commercial spaces with three ground floors devoted to them, according to the rules of new master plan. Moreover, a basement multilevel parking will also be developed.

The municipal quarters are spread over 90000 square meters and 9200 square meters in Azadpur and Model Town respectively. The development of these projects is likely to provide a revenue flow to the corporation which is going through a financial crisis.

According to the plan, the people currently living in the staff quarters will be given some other accommodation till the time the construction of the towers is completed, therefore, the corporation is hoping not to face any kind of reluctance from them.

Gulshan Homz To Develop Two Housing Projects In Delhi NCR While Investing Rs.400 Crore

Gulshan BellinaA well-known and leading name in the realty sector, Gulshan Homz, has announced that it will be investing more than Rs.400 crore for the development of two residential projects in Greater Noida and Noida in the next three years.

Combining the two projects, the company will develop around 1900 housing units.
Gulshan Homz, with its office in Noida, has launched a housing project in the name of ‘Gulshan Botnia’ on Noida Expressway with 768 units covering an area of 5.3 acres where cost is around Rs.48 lakh per unit.

In one more project, which is in the name of ‘Gulshan Bellina’, developing in Greater Noida West, the company will be carrying out construction on 7 acre land with 1124 housing units.

The Director of the company has said a total of Rs.400 crore will be invested by the company on the development of these projects.

He is expecting the market to get back in its full form after the implementation of RERA and GST.

He has also clearly stated that both the projects have got all the mandatory approvals and are also RERA compliant with the aim of handing over the possession by 2020 to homebuyers.

NGT Restricts Construction Of Artificial Lakes In Qutab Area, South Delhi

lakeThe advocates who were from the NGO’s side asked for an instant stay on the activities of construction, making it clear that the DDA has shown default in filing its reply even after various opportunities. They also alleged that the artificial lakes were being constructed in a full-fledged way even after the matter is extremely controversial.

As per the bench of NGT, the matter has been given a hearing date of 8th August, 2017, after the plea of ordering a stay on any such kind of construction activities by NGO CHETNA.

The development of these artificial lakes without any technical advice from the experts would result in an unsustainable water body, which is harmful for the environment.
