UPRERA hires consultants to offer solutions for troubled real estate projects in Noida and Greater Noida

According to chairman Rajive Kumar, the Uttar Pradesh Real Estate Regulatory Authority (UPRERA) has hired a consultant to perform a thorough examination of stalled projects, particularly contentious ones in Noida and Greater Noida, and offer options to settle them.

The decision would help homebuyers, according to Kumar. Next month, the consultant will turn in a project, and UPRERA will choose a course of action after consulting with the state administration. He said that UPRERA has undertaken numerous initiatives to finish stalled projects and offer relief to homebuyers. The majority of the actions were done in conjunction with several parties, including promoters and homeowners. 

In Noida and Greater Noida, there are a lot of contested or troubled real estate projects. Several of these projects are still under construction, but thousands of homeowners have invested in them and have been waiting for their apartments while making rent and house loan payments. 

According to Kumar, the agency has started more than a dozen projects in conjunction with homebuyers and promoters as a part of the relief initiatives. According to him, two of these projects have advanced to the point of requiring occupancy certificates. 

“We have hired a consultant to do an in-depth review of the projects in the Noida and Greater Noida area and to suggest potential remedies so that homeowners can quickly obtain their homes, according to UPRERA. Next month, when we anticipate receiving that report, we will discuss it with the state administration before deciding how to proceed,” said Kumar. 

For UPRERA digital version 2.0, Kumar stated a software developer will soon be appointed. According to him, UPRERA was a technology innovator, which is why it has so far been able to manage around 40,000 cases. According to him, UPRERA was the first to introduce e-courts in January 2020, and its complaints section was available online right away. 

He said that over 38% of all complaints in the nation are handled by UPRERA. The national capital area, which comprises New Delhi and a few districts in Haryana, Uttar Pradesh, and Rajasthan, accounts for over 75% of the complaints in Uttar Pradesh. 

According to data from UPRERA, over 47,000 complaints were filed and 42,000 were resolved between May 1, 2017, and December 31, 2022. The largest number of complaints addressed was 9,600 in 2020, when around 7,050 complaints were filed. There were roughly 200 complaints against agents, 500 complaints against allottees, and 46,400 complaints against promoters.

Realtor seeking checks after illegal commercial operated operate from DLF colonies

GURUGRAM: DLF areas have developed into a center for illegal commercial activity, including hair salons, gyms, grocery stores, clinics, and small restaurants.

The developer has provided the department of town and country planning (DTCP) with a list of 742 illegal commercial establishments that are located in its licensed colonies, DLF 1 to 4, to take legal action against the owners of these properties.

According to the developer, residential units were being used to conduct illegal commercial activities, which was against the rules established by the Haryana Development and Regulation of Urban Areas Act, 1975. The developer included a list of these residential properties along with a letter in which he claimed that these illegal commercial activities are burdening the community’s infrastructure more than necessary and aggravating locals. A response from these property owners is now required, according to the developer.

The company officials stated in a letter to the district town planner (enforcement) on March 29 that illegal commercial units, such as guest houses, boarding houses, restaurants, and offices, are also in violation of approved plans. The area’s population density has increased beyond what is sustainable, endangering amenities and services like water, sewage, electricity, and roads in DLF colonies.  

The developer continued, “We are receiving numerous complaints from RWAs and residents regarding issues they are having as a result of commercialization and illegal construction in residential areas. The law-abiding locals have suffered greatly as a result of these activities. The DTCP has been asked to take strict action against offenders in the interest of these residents because it has not only negatively impacted the amenities but also poses a serious risk to life and property and could result in a major catastrophe.

In response to the complaint, the department’s enforcement division formed a team led by an assistant town planner to carry out inspections and issue violation notices.

“We have received a letter from the developer on illegal commercial activities being run from residential areas,” district town planner Manish Yadav (enforcement) said. A team composed of two apprentice engineers and an assistant town planner has been assembled to conduct the surveys. Show-cause notices and restoration orders will be served to the identified properties after the survey is completed. According to him, building owners will have their occupation certificates revoked and a sealing drive will be conducted if they don’t restore the structures. Additionally, he said, “The department will write to the tehsildar not to approve the sale and purchase of such properties.”

The rules state that, with a few exceptions, residential buildings cannot be used for any commercial operations. A few non-nuisance activities are permitted only on the ground floor and are limited to no more than 25% of the space or 50 square meters, whichever is less. “Non-nuisance certificates” have only been granted to them. Non-nuisance professional activities are those that a person performs utilizing their abilities and intelligence.

Real Estate Body Urges Maharashtra Government to Cut Stamp Duty Rates for the Benefit of Consumers and Industry

The Confederation of Real Estate Developers’ Associations of India (CREDAI)-Pune Metro has called on the Maharashtra government to reduce stamp duty rates, citing that ready reckoner rates in many areas are higher than transaction market rates. The real estate body has been continuously pushing for a review of the issue with Chief Minister Eknath Shinde and Deputy Chief Minister Devendra Fadnavis.

The real estate industry body, CREDAI-Pune Metro, has urged the Maharashtra government to reduce stamp duty rates, which it says will benefit consumers, the industry, and the state government. The current stamp duty rate is 7%, which the organization says is unaffordable for middle-class homebuyers, who constitute 60% of the population. CREDAI-Pune Metro President Anil Pharande wrote a letter to Chief Minister Eknath Shinde, Deputy Chief Minister Devendra Fadnavis, and other officials concerned, emphasizing that a reduction in stamp duty rates would be a win-win situation for all stakeholders.

Pharande pointed out that reducing stamp duty rates would reduce the overall price of the unit, enabling consumers to pay lesser EMI and potentially reducing the term of their loan. For instance, CREDAI-Pune Metro Vice President Ranjit Naiknavare cited an example of a middle-class person buying a property in an urban area in the range of Rs 70-75 lakh. By reducing stamp duty rates by 3%, their EMI and interest would reduce, softening the financial burden on common homebuyers.

Naiknavare argued that reducing stamp duty rates would not affect the government revenue, citing past experiences amid the pandemic. The reduction of stamp duty would boost the real estate sector as more units would be sold, benefiting all three stakeholders. It would also help maintain stable economic growth.

CREDAI-Pune Metro has also called for a review of ready reckoner rates, which refer to the minimum rate based on which the government charges the registration fee. The organization believes that ready reckoner rates in many areas are higher than transaction market rates, causing a financial burden on homebuyers. By reviewing these rates, CREDAI-Pune Metro hopes to ease the burden on middle-class homebuyers and boost the real estate sector in Maharashtra.

Former Attorney General of India’s Wife Purchases Rs 160 Crore Bungalow in Delhi’s Golf Links

The prestigious Golf Links neighborhood of Delhi has recently welcomed a new addition to its high net-worth residents. Vasudha Rohatgi, the wife of former Attorney General of India Mukul Rohatgi, has reportedly purchased a luxurious 2,160-square-yard bungalow in the area for a whopping Rs 160 crore. According to the documents accessed by Moneycontrol, the sale deed shows that the bungalow has a plot area of 1806.35 sq m and a covered area of 1869.7 sq m.

The property’s registration was completed on February 24, and the family paid a stamp duty of Rs 6.4 crore for the purchase. Mukul Rohatgi has confirmed the transaction. It is noteworthy that Golf Links has limited availability, resulting in high property prices, which attracts many high net-worth individuals.

The Rohatgis’ new purchase has put them in the company of other corporate leaders who have invested in high-end properties in Delhi. Last year, former Solicitor General of India Gopal Subramanium bought an 866-square-yard bungalow in Lutyens’ Delhi’s Sunder Nagar for Rs 85 crore.

The Rohatgis’ neighbors in Golf Links include Bhanu Chopra of Rategain, Shailesh Arora of Maxop Engineering, and Pawan Agarwal of DB Group, who have also invested in expensive properties in the area. Chopra recently purchased a bungalow measuring 850 square meters for Rs 127.5 crore.

Slow Complaint Resolution at HRera Frustrates Homebuyers, Despite Increased Awareness

In Haryana, the Real Estate Regulatory Authority (HRERA) has faced criticism from homebuyers who have complained about the slow pace of complaint resolution. Despite increased awareness among homebuyers, HRERA has only resolved around 53% of complaints received in the past five years. This backlog has forced many homebuyers to approach other authorities for justice.

According to HRERA data, since February 2018, a total of 26,356 complaints have been submitted to the authority, of which only 13,133 were taken into consideration due to the regulator’s requirement for physical copies. Of these, the authority has decided on 7,031 complaints, while 6,102 are still pending. Out of the pending complaints, 4,747 are pending before the court, with only 981 cases having had their first hearing.

HRERA officials have attributed the backlog to the increased volume of complaints, pandemic-related hindrances, and a ban on proceedings related to refund cases for over a year. To address the issue, the authority has implemented various initiatives, including setting up a digital court to speed up complaint disposal.

However, the nearly 50% pendency of complaints before HRERA has left many homebuyers frustrated and seeking alternative platforms for justice. “The complaints before HRERA are moving very slowly. It gives developers time to manage irregularities, and aggrieved homebuyers are left with no option but to approach other authorities,” said Vikram Singh, an investor in an affordable housing project in Sector 62 who has been waiting for possession for six years.

A city-based lawyer also stated that the authority should not take more than 60 days to decide on a complaint as per the norms, but it usually takes four to six months, and sometimes even longer, to dispose of a complaint. The slow resolution of complaints has left homebuyers feeling helpless and highlights the need for HRERA to address the backlog and expedite the resolution process.

Noida Authority Warns Homebuyers of Financially Troubled Realty Projects

The Noida authority has recently released a list of 58 realty projects that have defaulted on land cost payments to the government, warning homebuyers not to invest in these projects. This move comes after much demand from homebuyers since 2017 for greater transparency in the real estate industry. The list includes all Noida developers, including Supertech, ATS, Logix, AIMS MAX Gardenia, Assotech, and 3C, who are categorized as financial defaulters.

According to Prasoon Diwvedi, officer on special duty, Noida authority, the details of all realty projects will be revised on a monthly basis. Interested parties can access the information online through the authority’s website.

Out of a total of 115 projects, 34 have been marked as “safe” because the promoters have paid their financial dues on time. Buyers may purchase flats and execute registrations in these projects. On the other hand, 65 projects are financial defaulters, and buyers cannot execute registry to transfer the property title to their names because the promoters have failed to pay dues to the authority. Fifteen of these 65 projects are facing insolvency and bankruptcy proceedings as they have defaulted on dues to lenders, including the Noida authority.

An anonymous Noida authority official explained that if a promoter pays the financial dues on time, the authority will allow the firm to execute registries, which paves the way for the transfer of the property title to the buyer. The authority prohibits registry on financial default so that the realtor is forced to clear the dues. The authority will revise the list on a monthly basis and remove the name of a builder from the defaulter category after they clear all dues.

Developers have responded to the list with criticism, stating that they will not come out of the defaulter category until the government comes up with a policy that enables them to make payments. Amit Modi, secretary of the Confederation of Real Estate Developers Association of India (CREDAI), a realtors’ lobbying group, explained that no realtor wants to be on the list of defaulters as it would make them ineligible for loans. They are unable to pay their dues because they are facing a financial crisis, and this crisis will only be addressed when the Uttar Pradesh government comes up with a policy that rationalizes their dues and waives the interest component.

Homebuyers have welcomed the authority’s move to make the list public. They believe that it will create awareness about realty projects and prevent new buyers from investing their life’s earnings in sick or stuck projects. “Even so, Noida authority delayed uploading the details for so many years. Had there been more transparency earlier, many would have been saved from investing in defaulted projects,” said Arun Chauhan, a buyer who bought a flat in Aranya project in Noida.

Adani Group is required to establish financial capability to receive Letter of Intent for Dharavi redevelopment bid

On Tuesday, Maharashtra Deputy Chief Minister Devendra Fadnavis stated that the Adani Group, which won the bid for Dharavi’s redevelopment, will only receive a Letter of Intent (LoI) once they have established their financial capability to undertake the project.

This statement was made in response to Congress MLA Varsha Gaikwad‘s concerns about the project’s future, following allegations of stock manipulation against the Adani Group made by Hindenburg Research.

Gaikwad asked if a new tender would be issued for the project, but Fadnavis defended the tendering process, stating that it was transparent and that the highest bidder was awarded the contract. The LoI will only be awarded after all departments have given their approval, including the Urban Development department, which has yet to make a decision, he added.

In November 2021, the Adani Group won the bid for the 259-hectare Dharavi Redevelopment Project with a bid of Rs 5,069 crore, beating DLF’s offer of Rs 2,025 crore. Fadnavis stated that the winning company must prove its financial capability and deposit a certain amount in a dedicated account before the LoI is issued.

Dharavi is located in central Mumbai and is known as Asia’s largest slum cluster, as well as a hub of small-scale, unorganized industries producing leather goods, footwear, clothing and other items.
